1. Acceptance of Terms

By creating an account, purchasing credits, or using the services provided by Bookidgo (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Service.

We operate as a Sole Proprietorship based in the People’s Republic of China.

2. Description of Service

Bookidgo is a SaaS platform that utilizes third-party Artificial Intelligence technologies (“AI Models”) to generate text and illustrations for children’s stories based on user inputs.

You acknowledge that:

  1. The Service relies on third-party AI providers (as detailed in our Privacy Policy).
  2. AI generation is probabilistic; we cannot guarantee the accuracy, quality, or uniqueness of the generated content.
  3. The Service is provided “as is” and “as available.”

3. Account Registration

To use certain features, you must register for an account. You agree to:

  • Provide accurate and complete information.
  • Maintain the confidentiality of your password.
  • Take responsibility for all activities that occur under your account.

Age Requirement: You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. While the content is for children, the Service itself is intended for use by parents and guardians.

4. Payments and Merchant of Record

We use Creem as our Merchant of Record (MoR).

  • Processing: All billing, receipts, and tax compliance are handled by Creem.
  • Liability: Creem is the entity selling the license to you. Any billing disputes must be directed to Creem‘s customer support, though we will assist where possible.
  • Credits: Our Service operates on a credit/subscription basis. Credits are virtual currency used to generate content and have no monetary value outside of our Service.

Refund Policy: Due to the non-returnable nature of AI generation costs (we incur costs with AI providers immediately upon generation), all purchases are final and non-refundable, except as required by applicable consumer law or at our sole discretion.

5. Intellectual Property and Content Ownership

5.1 Your Input

You retain ownership of the prompts and text inputs you provide to the Service. You represent that you have the rights to use such inputs and that they do not infringe on the rights of third parties.

5.2 AI-Generated Output

Subject to your compliance with these Terms, we hereby assign to you all rights, title, and interest in and to the specific Stories (text and images) generated by you using the Service (“Generated Content”) for your personal or commercial use.

5.3 Platform License

You grant us a non-exclusive, worldwide, royalty-free license to host, store, and display your Generated Content solely for the purpose of providing the Service to you (e.g., showing your history).

5.4 AI Disclaimer

You acknowledge that AI models may generate similar or identical content for other users who enter similar prompts. You do not hold exclusive rights to the underlying AI styles or general concepts.

6. Acceptable Use Policy

You agree NOT to use the Service to generate content that:

  1. Is sexually explicit, obscene, or pornographic.
  2. Promotes violence, hate speech, harassment, or self-harm.
  3. Infringes on the copyright or trademark of others (e.g., asking for specific Disney characters).
  4. Violates the usage policies of our underlying AI providers (e.g., Google’s Generative AI Prohibited Use Policy).

We reserve the right to ban any account found violating these rules without refund.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  1. AI Hallucinations: We are not liable for any offensive, inaccurate, or inappropriate content generated by the AI. You are responsible for reviewing all content before sharing or showing it to children.
  2. Damages: In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data.
  3. Cap on Liability: Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid to us in the three (3) months preceding the claim.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the People’s Republic of China, without regard to its conflict of law principles.

Any dispute arising out of or in connection with these Terms shall be submitted to the Shanghai International Economic and Trade Arbitration Commission (SHIAC) for arbitration. The language of arbitration shall be English.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or a prominent notice on our website. Your continued use of the Service constitutes acceptance of the new Terms.
